The California Penal Code Section 647 (b) states solicitation is when a person "agrees to engage in or who engages in any act of prostitution. A person agrees to engage in an act of prostitution when, with specific intent to so engage, he or she manifests an acceptance of an offer or solicitation to so engage, regardless of whether the offer or solicitation was made by a person who also possessed the specific intent to engage in prostitution."

Such a sting is usually done by having scantily clothed undercover female police officers pose as prostitutes on street corners. Once they establish that a person is offering money in exchange for sex or sexual acts, the "John" is arrested. According to California law, a person need not necessarily actually perform a sex act, but merely the act of requesting such a favor in exchange for money or valuables is enough to be charged under this law.
